The proposed variation to allow an extension to the approved openings hours of the tea garden to 21.30 hours fails to meet the requirements set out in Core Policies B & H and Development Policy 14 of the NYM Core Strategy and Development Plan documents which amongst other criteria considers that proposals should not result in a development that will generate an increased level of activity including noise, which is likely to detract from both the experience of visitors and the quality of life of local residents. The level of activity that would be generated by the request to open until 21.30 hours is considered to be harmful to the quiet enjoyment of this part of the National Park for both adjoining residents and visitors alike. For these reasons, the proposal is considered to be contrary to Core Policies B & H and those requirements set out in Development Policy 14 of the NYM Core Strategy and Development Plan documents.
